These Terms of Service (“Terms”) govern your access to and use of truckspace.co and any related pages, content, and forms (the “Site”), operated by Truckspace Holdings, LLC, a Delaware limited liability company, and its affiliates (“Truckspace,” “we,” “us,” or “our”). Please read these Terms carefully. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Acceptance of terms
By accessing or using the Site, submitting information through any form, or otherwise interacting with us through the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
2. Eligibility
The Site is intended for business and professional use by individuals who are at least 18 years old and able to form a binding contract. By using the Site, you represent that you meet these requirements and that any information you provide is accurate and that you are authorized to provide it.
3. The Site & our services
The Site provides general information about Truckspace, our truck parking and industrial outdoor storage (“IOS”) operations, and partnership opportunities, and allows you to submit information for a confidential feasibility review. The Site and its content are provided for informational purposes only. Nothing on the Site constitutes an offer, solicitation, commitment, or binding agreement of any kind, and submitting information does not create any partnership, agency, joint venture, brokerage, or other relationship between you and Truckspace. Any partnership or transaction will be governed solely by a separate written agreement signed by authorized representatives.
4. No investment, legal, or tax advice
Content on the Site — including market commentary, yield ranges, occupancy figures, case studies, and articles in our “Monitor the Trucks” section — is provided for general informational purposes only and does not constitute investment, financial, legal, tax, accounting, or real estate advice, and should not be relied upon as such. You should consult your own professional advisors before making any decision. Truckspace is not acting as a fiduciary, broker, or adviser to you by providing this content.
5. Forward-looking statements & no guarantee of results
Important: Any returns, yields, occupancy rates, revenue figures, timelines, or projections referenced on the Site are illustrative estimates based on assumptions and past or current operations. They are not promises or guarantees of future performance. Actual results vary and depend on market conditions, site characteristics, entitlements, and other factors outside our control. Past performance is not indicative of future results.
Statements about future events or performance are “forward-looking” and inherently uncertain. We undertake no obligation to update any forward-looking statement, and you should not place undue reliance on them.
6. Property & other submissions
When you submit property details, inquiries, or other information through the Site, you represent that the information is accurate and that you have the right to share it. We may use submitted information to evaluate a potential partnership and to contact you. Submission imposes no obligation on Truckspace to respond, pursue, or enter into any transaction. Except for personal information, which is handled under our Privacy Policy, and any information covered by a separate written confidentiality agreement, you grant us a non-exclusive, royalty-free license to use submissions for the purpose of evaluating and responding to your inquiry. Do not submit confidential information you do not wish to share unless a separate confidentiality agreement is in place.
7. Intellectual property
The Site and all of its content — including text, graphics, logos, the “Truckspace” name and marks, design, and software — are owned by or licensed to Truckspace and are protected by intellectual property laws. You may view and use the Site for your own internal, non-commercial evaluation purposes. You may not copy, reproduce, republish, distribute, modify, or create derivative works from the Site or its content without our prior written permission. All rights not expressly granted are reserved.
8. Acceptable use
You agree not to:
- Use the Site for any unlawful, fraudulent, or harmful purpose;
- Submit false, misleading, or unauthorized information;
- Interfere with or disrupt the Site, its security, or its servers;
- Attempt to gain unauthorized access to any portion of the Site or related systems;
- Use automated means (bots, scrapers) to access or collect data from the Site without our permission; or
- Use the Site to transmit spam, malware, or other harmful code.
9. Third-party services & links
The Site may contain links to or integrate third-party websites and services, including TheRighut, and uses third-party providers for hosting, email, and analytics. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms and policies.
10. Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT INFORMATION ON IT IS ACCURATE, COMPLETE, OR CURRENT.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TRUCKSPACE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify, defend, and hold harmless Truckspace and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your submissions, or your breach of these Terms.
13. Governing law & disputes
